1. Who is responsible for your data

Creator Upside is operated by Philidor Solutions, trading as My Digital Marketing, in the Netherlands. Philidor Solutions is registered with the Dutch Chamber of Commerce (KVK) under number 73071579 and is the data controller for personal information collected through this website.

2. Information we collect

If you submit the channel review form, we may collect your name, email address, selected social platform, channel or account name or URL, approximate follower or subscriber count, and any information you choose to provide about your content or goals.

Basic technical information may also be processed by our hosting provider as necessary to deliver and secure the website.

3. Why we use your information

We use information submitted through the form to review your creator channel or account, assess possible digital-product opportunities, respond to your enquiry and, where relevant, discuss a potential Creator Upside partnership.

We do not sell your personal information.

4. Legal basis

Where you ask us to review your channel or contact you about a possible partnership, we process the information you provide in order to respond to your request and take steps toward a possible business relationship. Where appropriate, we may also rely on our legitimate interest in operating and protecting our business, provided that this does not override your rights and freedoms.

5. How long we keep information

We keep enquiry information only for as long as reasonably necessary to respond, assess whether there is a potential partnership and maintain appropriate business records. Information that is no longer needed will be deleted or anonymised unless a longer retention period is required by law.

6. Service providers

The website is hosted using Cloudflare infrastructure. Channel review form submissions are processed by Formspree, Inc. on our behalf so that the information you submit can be delivered to us and managed as an enquiry. Formspree may process and store the submitted form data as part of providing that service.

Formspree publishes information about its privacy and security practices at formspree.io/security.

7. International transfers

Some technology providers may process information outside the European Economic Area. Formspree states that its services are hosted with Amazon Web Services in the United States and that it relies on Standard Contractual Clauses (SCCs) as a data processor for relevant transfers. Where international transfers apply, we use providers that offer appropriate legal mechanisms or safeguards where required.

8. Cookies and analytics

At launch, this website is intended to operate without advertising trackers or non-essential analytics cookies. If analytics, advertising or other non-essential tracking is added later, this policy and any required cookie controls will be updated before that tracking is enabled.

9. Your rights

Depending on the circumstances, you may have rights to access, correct or delete your personal data, restrict certain processing, receive certain data in a portable format, or object to processing based on legitimate interests. You may also lodge a complaint with the Dutch Autoriteit Persoonsgegevens or another competent supervisory authority.
